Welcome to the Lucky Rewards Program (the "
Program"), a valuable enhancement to your Lucky Magazine subscription (your "
Subscription") that will provide you with even more opportunities to save money when you shop!
Please read these Terms and Conditions carefully before using the Program. These Terms and Conditions constitute the agreement governing your use of and participation in the Program. By participating in the Program, you signify your agreement to these Terms and Conditions.
If you do not agree to these Terms and Conditions, you hereby are given notice that you may not participate in the Program. As the Program is constantly evolving, we reserve the right, in our sole discretion, to amend, modify, add or delete portions of these Terms and Conditions at any time in accordance with the procedures set forth below in the section labeled "
Amendment". Please check these Terms and Conditions periodically for changes.
Lucky and Mall Networks receives a commission for every sale in Lucky Shopping and Lucky Rewards.If you are a Lucky Magazine subscriber, you automatically are eligible to participate in the Program. If you are not yet a subscriber, you are eligible to experience the free benefit of the Program that is exclusively available to Lucky Magazine subscribers for a trial shopping period of 90 days from the date you register for the Program, and such trial period automatically will expire at the end of such 90-day trial period unless you become a subscriber of Lucky Magazine prior to the expiration of the 90-day trial period.
Under the Program, you can accrue Program Rewards ("
Program Rewards") by shopping online with retailers who participate in the Program ("
Participating Retailers") when you use the links found only at
rewards.luckymag.com or
shopping.luckymag.com (collectively, the "
Site"). You can request that a check be issued for your accumulated Program Rewards ("
Reward Check") or we otherwise automatically will send you a Lucky Rewards Visa
® Prepaid Card ("
Card") once your Program Rewards reach the Redemption Threshold according to the payment schedule. The Redemption Threshold and payment schedule are detailed in Section 4 below.
Full terms of the Program are set forth below. In these terms, "
we", "
our" and "
us" refers to Mall Networks, Inc., the manager of the Program. These terms are binding on you as long as you are enrolled in the Program. They are also binding after your enrollment in the Program is terminated, as to any issue or transaction that occurred during your enrollment.
- Your Enrollment. You requested enrollment in the Program when you returned the Program registration card or registered online at the Site. Your enrollment in the Program is conditioned on your continued status as a subscriber of Lucky Magazine. The Program is open and offered only to legal residents of the 50 United States and the District of Columbia, and any access or use of the Program outside of the United States is at your own risk and you will be solely responsible for compliance with the laws of your jurisdiction regarding online conduct and acceptable content. Except with respect to any one-time trial period, your initial enrollment in the Program is for the period of your Lucky Magazine subscription.
- To enroll in the Program, you must be at least 18 years of age, have a valid Lucky Magazine subscription mailing address, and have no other enrollments in the Program. The mailing address you provided for your Program enrollment will be the address we use for the Program, not your Lucky Magazine subscription mailing address. We reserve the right to limit enrollment, or to close the Program to new enrollments at any time.
- You may cancel your enrollment in the Program by visiting the Contact Us forum of the Site or by contacting us at the information provided in Section 15 (Contact Information). We may also cancel your enrollment in the Program for any reason, at any time - for example, if the Program is terminated, or if we determine that you have violated Program rules. Additionally, if the credit card associated with your Lucky Magazine subscription is cancelled, if charges for your Lucky Magazine subscription are not honored, or if you cancel your Lucky Magazine subscription, your enrollment in the Program will be automatically terminated in our sole discretion.
- Currently, there is no fee for enrollment or any annual fee to participate in the Program as long as you continue as a Lucky Magazine subscriber. If we institute an annual fee at any future time, we will notify you and give you the right to cancel your enrollment in the Program before the fee is imposed.
- Accumulating Program Rewards. You can accumulate Program Rewards based on the dollars you spend (net of returns and credits) at Participating Retailers when you shop using the links at the Site during each enrollment period. You will not start accumulating Program Rewards until we have received information about your Lucky Magazine subscription and you have registered at the Site and shopped using the links on the Program Web site.
The amount of Program Rewards you accumulate for each dollar you spend will vary by Participating Retailer and by offer. Any returns or credits related to your purchases at a Participating Retailer will be netted out of your spending at such Participating Retailers for Program Rewards accumulation purposes, or will result in a deduction of Program Rewards already accumulated.
Program Rewards accumulation rules depend on the continuing participation of Participating Retailers, and are subject to change at any time, without notice to you. You can find out the current Program Rewards accumulation rules, and check on your accumulated Program Rewards, at any time by visiting the Contact Us forum of the Site or by contacting us at the information provided in Section 15 (Contact Information).
- Though Participating Retailers have committed to participate in the Program, your accumulation of Program Rewards based on your spending at Participating Retailers depends on our receipt of information about your spending and fulfillment by the Participating Retailer of its contractual obligations. Some Participating Retailers only participate online ("Affiliate Retailers") and your Program Rewards will only be awarded for purchases made at these Affiliate Retailers if you click through from the Site. See individual Affiliate Retailer offers and their terms at the Site.
We will track and apply new Program Rewards to your accumulated balance of Program Rewards once we receive information from the Participating Retailer that you have in fact made purchases through their respective link on the Site and met their respective terms and conditions for the offer.
If you believe that you have made purchases that should have resulted in the addition of Program Rewards to your accumulated Program Rewards balance, and you see that the Program Rewards have not been reflected within forty-five (45) days after your purchase (deemed to be the date the charge appears on your credit card statement), you can contact us by visiting the Contact Us forum of the Site or by contacting us at the information provided in Section 15 (Contact Information) within ninety (90) days after the date of such purchase and we will investigate the situation. (If you wait longer than 90-day period, your ability to claim the Program Rewards will be considered waived.)
We may ask you for documentation of your spending you contend should have resulted in Program Rewards accumulation. However, if the Participating Retailer does not fulfill its obligations with respect to the Program Rewards, or if the Participating Retailer does not agree that the Program Rewards should have been accumulated, we will not have an obligation to add them to your Program Rewards balance.
You acknowledge that we may audit all transactions initiated via the Site for which Program Rewards are claimed to verify that the transaction in question qualified for the award, was completed, and has not been cancelled or reversed. You acknowledge that if we suspect fraud, we may investigate and report any evidence, including any personal information gathered during your use of the Site or participation in the Program to law enforcement or other governmental or judicial authorities.
- You understand that Program Rewards have no cash value and can only be redeemed for Reward Checks, Cards or other available rewards, while your enrollment in the Program is in effect. You have no ownership rights in any Program Rewards you accumulate, but you will own any Program Rewards Check or Card once we mail it to you.
- No written confirmation of your accumulated Program Rewards will be sent to you. However, you can check your accumulated Program Rewards online at the Site, or you can visit the Contact Us forum of the Site or contact us at the information provided in Section 15 (Contact Information.
- Program Rewards Expiration. Your Program Rewards don't expire, so long as you maintain your Lucky Magazine subscription. All accumulated Program Rewards which have not been previously redeemed, will only expire and be forfeited in the event your Lucky Magazine subscription is terminated, cancelled or not renewed, in accordance with Section 6 below.
- Redeeming Program Rewards. The Program provides you with the opportunity to redeem your Program Rewards for Reward Checks or Cards, once your Program Rewards balance reaches at least $15 (the "Redemption Threshold"), or for other available options we may make available from time to time.
Your current Program Rewards are listed on the Site and you can visit the Contact Us form of the Site or contact us at the information provided in Section 15 (Contact Information) if you have questions.
Cards will be processed four times during the year: in May for Program Rewards accumulated as of March 31st; August for Program Rewards accumulated as of June 30th; November for Program Rewards accumulated as of September 30th; and February for Program Rewards accumulated as of December 31st. You will automatically receive a Lucky Rewards Visa Prepaid Card if you've earned $15 or more in Program Rewards as of the above dates. You will receive your Card or check at the address you registered in the Program within 30 days after the applicable processing date. You agree that we may share any required information with our third party fulfillment vendor for the issuance of Reward Checks or Cards.
- Member Obligations. You agree that you will not attempt to transmit any offers or Rewards offered under the Program to any other person, and that you will not misuse the Program. The Program Rewards you have accumulated may not be sold, transferred, assigned, exchanged, donated or traded. You will be solely responsible for any tax liability, including all applicable filing and reporting obligations, connected with the receipt or use of the Program Rewards earned by you through your participation in the Program. You also agree to let us know, by visiting the Contact Us forum of the Site or contacting us at the information provided in Section 15 (Contact Information), if your address or other information changes.
- Enrollment or Program Termination. If you or we terminate your Lucky Magazine subscription, or your enrollment in the Program, you will no longer be able to accumulate Program Rewards. At that time, if you have any accrued Program Rewards valued at less than the Redemption Threshold, we will provide you with six (6) months to renew your subscription to Lucky Magazine to preserve the Program Rewards you accumulated. Such six (6) month period will begin from either the date we notified you of termination, or the effective termination date, whichever is earlier.
At the time of termination, you may request redemption of the Program Rewards, even if less than the Redemption Threshold amount, by written request through the Contact Us forum of the Site or written request at the information provided in Section 15 (Contact Information) within such six-month period. If we receive your written redemption request within said six-month period, we will send you a Reward Check for your Cash Back Rewards balance less a processing fee of $2.50. If you do not renew your subscription to Lucky Magazine or request redemption of the Program Rewards within such six-month period, then any Program Rewards are forfeited, and you will have no rights to redeem such Program Rewards.
- Limited Liability. Neither we, Advance Magazine Publishers, Inc., The Conde Nast Publications, Lucky Magazine, nor any other vendor for the Program, nor any of their affiliates, officers, directors, employees, or agents will be liable to you, or anyone making a claim on your behalf, in connection with (i) the failure to add Program Rewards to your balance based on your spending at any Participating Retailer who fails to fulfill its obligations under the Program (such as transmitting information concerning your spending); (ii) any change in rewards which is reflected on the Site; (iii) any forfeiture of Program Rewards due to termination of the Program or your enrollment; (iv) any dispute you may have with any Participating Retailer or related to your transactions with, or purchases from the Retailer, (v) any loss, damage, expense or inconvenience caused by any occurrence outside of our control, or (vi) any content, products or service appearing on a Web site to which we provide a link from the Site. Additionally, none of us makes any warranty of merchantability or fitness for a particular purpose, or assumes any implied warranty obligations.
- Additionally, if you redeem Program Rewards for a Card, neither we, nor Advance Magazine Publishers, Inc., The Conde Nast Publications, Lucky Magazine nor any other vendor for the Program (other than the Card issuer) will be responsible in any way for the terms of any Card or your use of the Card once it is issued, and you will look solely to the Card issuer to resolve any claims or disputes you may have concerning the Card or its use.
- We are not responsible for any issue relating to your Lucky Magazine subscription, and any such issues must be resolved between you and Lucky Magazine.
- In any event, any liability we, Advance Magazine Publishers, Inc., The Conde Nast Publications, or Lucky Magazine may have to you hereunder shall be limited to no more than $100.
- Amendments. We may terminate, change or temporarily suspend the Program, or change the Program rules or awards at any time, with or without notice, in our sole and absolute discretion. This means that the accumulation of Program Rewards does not entitle you to any vested rights with respect to the Program Rewards, awards, or Program benefits. In accumulating Program Rewards, you may not rely on the continued availability of any award or award level, and you may not be able to obtain all offered awards. Any award may be withdrawn, or the Program Rewards requirement relating to it may be changed, at any time. These changes may affect the value of, or your ability to use, any accumulated Program Rewards. Additionally, we may amend these terms at any time, and the changes may apply to accumulated Program Rewards, as well as the Program in general.
- Privacy Policy. As a condition to using the Site, you agree to the terms of our Privacy Policy, as the same may be updated from time to time. While we understand that privacy is important to you, you agree that we may monitor, edit, or disclose your personal information in order to comply with any valid legal proceedings or government request, or as otherwise provided in these Terms and Conditions or our Site Terms. For more information, please see our Privacy Policy, which forms a part of these Terms & Conditions and is incorporated by reference.
- Information We Collect and Use. Proper functioning of the Program (including the tracking of Program Rewards and distribution of awards) depends on an exchange of information among us, Advance Magazine Publishers, Inc., The Conde Nast Publications, Lucky Magazine, Participating Retailers, and each of our vendors. The information we exchange includes information about your Lucky Magazine subscription and your spending at Participating Retailers. We will not use or share with others your spending information for purposes other than to administer the Program. Please see our Privacy Policy for further information.
- Third Party Content and Links. We expressly disclaim any responsibility for the accuracy, completeness or availability of information, content and materials found on sites that link to or from the Site. We cannot ensure that you will be satisfied with any products or services that you purchase from a third-party site that links to or from the Site, or any third-party information, content or materials contained on the Site, including without limitation user generated content. We do not endorse any of the merchandise, nor have we taken any steps to confirm the accuracy, completeness or reliability of, any of the information, content or materials contained on any third-party site. Please refer to each third party website for all terms and conditions relating to a transaction on such website, including but not limited to guarantees and warranties, payment terms, shipping, delivery, taxes, return policies and processing of returns. We make no warranties and disclaim responsibility for fulfillment of any transaction between you and any third party.
We do not make any representations or warranties as to the security of any information, content or materials (including without limitation credit card and other personal information) you might be requested to give to any third party on or through any such third party website, all of which will be governed by the applicable terms and conditions of use, privacy policies and other relevant agreements governing the use of such third party website. You hereby irrevocably waive any claim against us with respect to information content and materials contained on any third party sites, and any liability arising from or in connection with information, content or materials provided by you to such third party sites. We strongly encourage you to make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.
- Intellectual Property. All information, content and material contained on the Site are our copyrighted property or the copyrighted property of their respective owners and used with permission by us. All trademarks, service marks, trade names, and trade dress are proprietary to us and/or our licensors or licensees. No information, content or material from the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, except that you may download one copy of the information, content or materials on any single computer for your use only, provided that (i) you keep intact and do not modify in any way all copyright and other proprietary notices, (ii) you make no modifications to the information, content or materials, (iii) you do not use the information, content or materials in a manner that suggests an association with any of our products, services or brands, and (iv) you do not download information, content or materials so as to avoid future downloads from the Site. The use of any information, content or materials contained on the Site on any other website, computer environment or otherwise, whether in original or derivative form, is strictly prohibited.
- Disclaimer. These Terms and Conditions contain the entire agreement between us concerning the Program. Cards are issued by Citibank, N.A. pursuant to a license from Visa U.S.A. Inc. and managed by Ecount, a Citi company. Cards may be used everywhere Visa debit cards are accepted.
